Data.AustinTexas.gov is the official open data portal of the
City of Austin, Texas (the City). The City may have sources of other publicly
available information, to which these terms of use also apply.

in metadata, data sets available on Data.AustinTexas.gov are in the public
domain.

By using data made
available through this site, the user agrees to all the conditions stated in
the following paragraphs as well as the terms and conditions described under
the City of Austin Privacy Notice.

MAKES NO REPRESENTATIONS OR WARRANTY AS TO THE COMPLETENESS, ACCURACY, QUALITY,
TIMELINESS, CONTENT, OR ANY OTHER ASPECT
OF ANY DATA MADE AVAILABLE THROUGH THIS SITE. THE CITY OF AUSTIN EXPRESSLY
DISCLAIMS ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES
OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
It is understood that
the information contained in the site is being used at your own risk.
Unless otherwise
indicated, City of Austin Departments and agencies who submit the data available
on Data.AustinTexas.gov are the source of the data available on the Open Data
Portal. These Departments retain control of the data sets and feeds accessed on
the Data.AustinTexas.gov and therefore the published data may be updated,
corrected, or refreshed at any time.
Confidentiality
The City uses methods
to protect individual privacy, such as through the removal or obfuscation of
personally identifiable information ("PII") or location data. You
hereby understand and agree that you will not take any measures to re-identify the
Data or to contact individuals whose information is represented by the Data.
You shall not combine the Data with data from any other data sets for the
purpose of re-identification of individuals. In the event that the Data is
re-identified, and you become aware of such event, you are responsible for
ensuring that any PII is immediately destroyed and that no PII is disclosed to
any other individual or entity, and you are responsible for promptly notifying
the City of such re-identification and providing proof to the City of the
destruction of any PII.
Attribution When Using the Data
We ask that proper
credit be given when using content, data, documentation, code, and related
materials from Data.AustinTexas.gov or other sources publicly available from
the City of Austin in your own work. Please provide attribution to both the
City of Austin and the City department that is the source of the cited data.

Right to Modify and/or Discontinue Feeds
The City of Austin
reserves the right to modify and/or discontinue providing any or all of the
data feeds at any time. The City may require the termination of any and all
displays, distribution, or other use of any or all of the data for any reason.
Reasons may include, without limitation, your violation of any provision of
these Open Data Portal Terms of Use.
Applicability
Nothing in this Data
Policy alters or impedes the ability of authorities of the departments and
agencies of the City of Austin to perform their responsibilities under law in a
manner that is consistent with applicable legal, regulatory or City requirements.
Nor does this Data Policy limit the protection afforded any information by
other provisions of law. This Data Policy is intended only to improve the
internal management of information controlled by the City and it is not
intended to, and does not, create any right or benefit, substantive or
procedural, enforceable at law or in equity, by a party against the City of
Austin, its Departments, elected and appointed officials, officers, employees,
or agents.
